Driver of truck unloading and car overturning in shopping mall sentenced to probation – Arma I

A Dungannon man was convicted of dangerous driving for causing a truck to unload and the car toppled in the center of Armagh. He has been sentenced to three months' imprisonment with a two-year probation.

Speaking of the seats left on the roof, the district judge told the 42-year-old: “You can’t imagine how scared these two women were when they were hit by a truck and then hit by another car.”

Bosco Don Donnolly of Coolough Drive appeared in court for dangerous driving, failure to park where the accident occurred, failure to report the accident, and failure to stay at the scene of the accident at the Armagh Magistrates Court. He sat in Newry on Tuesday.

These allegations are related to an incident that occurred on January 11, when a truck carrying a prefabricated cabin was unloaded at Mall West.

The court heard that the hut was already a shed after being knocked down by a tree branch.

During the incident, a wall in the shopping center and three other vehicles were damaged.

The prosecutor claimed that the defendant drove into a Seat Leon, the car collided with a Caddy van, and hit a Ford Fiesta.

After the incident, Seat Leon was overturned on the roof of the car, while the two female passengers were still in the car.

According to reports, Donnelly continued to move forward, and District Judge Bernie Kelly questioned his reason for doing so.

Defense attorney Patrick Taggart said there was no answer.

He explained: "He continued to drive along Newry Road, and then he thought about it. When he turned on his broad, hard shoulders, the police came."

He said that in an interview with the police, his client seemed "distracted" by the incident.

On Tuesday, Mr. Taggart stated that the court had received a "detailed" probation report and he "expressed gratitude to the author".

He commented that this case was "obviously" a dangerous driving, and Donnelly was "very lucky, and the injuries were not more serious."

Mr. Taggart added that it was "completely out of date" for his clients and "severely affected him."

District Judge Kelly said: "Mr. Donnelly, you are or were a so-called professional driver... At the time of this incident, you were carrying a considerable amount of cargo.

"The public expects a higher level of care from truck drivers. A truck can cause more damage than a small car."

Donnori was sentenced to three months in prison, suspended for two years, and disqualified from driving for 12 months.
